Terms of Service

These Terms of Service ("Terms") govern your access to and use of Valarcha ("Valarcha", "we", "us"), an Instagram analytics, audience-insights, growth-recommendation, and content-scheduling service. By creating an account, connecting an Instagram account, or otherwise using Valarcha, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

1. Who can use Valarcha

• You must be at least 18 years old (or the age of majority where you live).
• If you use Valarcha on behalf of a business or another person, you confirm you are authorized to do so and to bind them to these Terms.
• You may connect only Instagram professional (Business or Creator) accounts that you own or are authorized to manage.

2. What Valarcha does

Valarcha reads your connected Instagram account through Instagram's official APIs to provide analytics, audience insights, growth recommendations, and — with your explicit action — content scheduling and publishing. Insights and recommendations are informational only. Results vary, and we do not guarantee any specific outcome, including follower or engagement growth.

3. Your Instagram connection

You connect your account through Instagram's official OAuth; we never receive your Instagram password, and you can revoke access at any time from Instagram → Settings → Apps and websites. We access only the data your granted permissions allow, as described in our Privacy Policy. You remain responsible for complying with Instagram's and Meta's own terms and policies.

4. Acceptable use

You agree that you will not use Valarcha to:

• Buy, sell, generate, or inflate followers, likes, views, comments, or any other engagement, whether real or fake.
• Operate bots or automation that violate Instagram's or Meta's terms.
• Collect, scrape, or profile data about other people without a lawful basis and their required consent.
• Create, schedule, or publish content that is illegal, infringing, deceptive, hateful, harassing, or that violates Instagram's Community Guidelines.
• Interfere with, overload, probe, or attempt to reverse-engineer or gain unauthorized access to the service.
• Resell, sublicense, or misrepresent the service.

Valarcha uses only official Instagram APIs and does not provide fake engagement of any kind.

5. Content you create and publish

You are solely responsible for any content you draft, schedule, or publish through Valarcha, and you represent that you own or have all necessary rights to it. When you use the publishing feature, you instruct and authorize us to publish that content to your connected Instagram account on your behalf via the Instagram API, at the time you choose. We do not review your content and are not responsible for it or its consequences.

6. Availability and changes to the service

Valarcha is provided on a best-effort basis and may be changed, interrupted, limited, or discontinued at any time. Features (including any free tier) may change. The service depends on the Instagram API, which Meta may modify or restrict outside of our control; such changes may affect or disable parts of Valarcha.

7. Fees

Valarcha may be offered free of charge or under plans described on the site. We may introduce, change, or remove fees, giving you reasonable notice before any charge applies to you.

8. Intellectual property

Valarcha, including its software, design, branding, and content, is owned by us and protected by law. You receive a limited, non-exclusive, non-transferable right to use the service under these Terms. You retain all ownership of your own Instagram content and data.

9. Disclaimers

The service, and all analytics and recommendations, are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted or error-free, that data retrieved from Instagram is accurate or complete, or that using Valarcha will grow your account.

10. Limitation of liability

To the maximum extent permitted by law, Valarcha and its operator will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, followers, revenue, goodwill, or account access — including any action Instagram or Meta takes on your account. Our total liability for any claim relating to the service is limited to the amount you paid us for it in the twelve months before the claim (or a nominal amount if the service was free).

11. Suspension and termination

You may stop using Valarcha and disconnect your accounts at any time. We may suspend or terminate your access if you violate these Terms or misuse the service. On termination, your data is handled as described in our Privacy Policy.

12. Relationship to Instagram and Meta

Valarcha is an independent tool and is not affiliated with, endorsed by, sponsored by, or administered by Instagram or Meta Platforms, Inc. "Instagram" and "Meta" are trademarks of Meta Platforms, Inc. Your use of Instagram remains governed by Instagram's own terms and policies.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new "Last updated" date. Your continued use of Valarcha after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Any dispute arising from these Terms or the service is subject to the exclusive jurisdiction of the courts of Kerala, India.
